US appeals court overturns ruling, that 9/11 victims can't sue Saudi Arabia

A federal appeals court in New York City has revived litigation against Saudi Arabia on behalf of families of victims of the September 11, 2001, attacks.

More than twelve years after the 9/11 attacks and eight years after a lower federal court ruled Saudi Arabia had immunity from prosecution, a three-judge panel of the 2nd US Circuit Court of Appeals in Manhattan ruled on Thursday that families of 9/11 victims can get their day in court against Saudi Arabia.

According to the families of 9/11 victims, the kingdom provided support to al-Qaeda prior to the attacks which killed nearly 3,000 people.

“This opinion is eminently correct and will give 9/11 victims their day in court,” said Stephen Cozen, a partner at the Pennsylvania-based law firm Cozen O'Connor representing the plaintiffs.

“The parties will start over, and we are very, very satisfied that we will meet any defenses, both legal and factual, that are raised,” Cozen added.

The litigation began in 2002, just one year after the 9/11 attacks, when families of the victims said that Saudi Arabia and a charity affiliated with the Saudi government knowingly provided al-Qaeda with funds and other material support to help them carry out the attacks.

However, in 2005, US District Judge Richard Casey dismissed the case ruling that the kingdom was immune from prosecution under the federal Foreign Sovereign Immunities Act.

In 2008, a 2nd Circuit Court panel upheld the ruling on different grounds but the same interpretation of sovereign immunity law did not apply to Afghanistan against which a 2011 decision allowed similar claims to proceed.

It would be “especially anomalous” to treat the two cases differently, Circuit Judge Chester Straub wrote for the three-judge panel on Thursday, Reuters reported.

“I’m ecstatic, because we have a lot of information and evidence,” William Doyle, who lost his 25-year-old son in the attacks, told the New York Daily News.

Fifteen of the 19 September 11 attackers were Saudi nationals who flew hijacked planes into the World Trade Center in New York City, the Pentagon in Washington, D.C., and into a field in Pennsylvania.

Moreover, many Americans and families of the attacks’ victims say there is more to the tragic event than just planes hijacked by Saudi nationals, talking about the controlled demolition of the World Trade Center, Israeli complicity in the events, and many other issues.

Critics have indicated, among other things, to bombs and explosives planted at the World Trade Center that demolished the buildings, jubilant Israeli intelligence agents photographing the attacks, made-up phone calls from the planes, and a warning by the Mossad (the Israeli spy agency) one day before the attacks to Israeli Tower workers and occupants to stay away from the buildings.

A former CIA agent, Susan Lindauer, has also indicated the role of the US intelligence apparatus in the attacks.

Lindauer talks about the CIA’s detailed knowledge of the time, target, and means of the 9/11 attacks over the months prior to the events, saying the “lies are so much bigger than what you know.”

Congress cites 9/11 Bush cover-up, demands Obama act

Two members of Congress, specially authorized to view documents on 9/11 censored under the personal authority of President Bush (43), have come away “absolutely shocked,” demanding immediate action.

However, the full story, told for the first time below, explains “why now” and who is really being targeted by revelations of cover-up and conspiracy.

In accusations published yesterday by the leading Tea Party publication, Family Security Matters, Saudi Defense Minister and Intelligence chief Prince Bandar referred to as “Bandar Bush” in his Wikipedia biography for his close relationship with that family, was said to be the planner of 9/11.

In an article by Paul Sperry of the Hoover Institute, Bandar was cited with fleeing the US to avoid prosecution. Here, Sperry quotes a government source: “Our investigations contributed to the ambassador’s departure,” an investigator who worked with the Joint Terrorism Task Force in Washington told me, though Bandar says he left for “personal reasons.”

Despite these pronouncements, these accusations may well be unfounded speculation. What we have to ask is why are they being made now and why by political groups long close to the Saudi government. Why has Saudi Arabia failed to respond to these very public accusations coming from some of the highest authorities in Washington? “Why are the rats turning on each other?”

Startling disclosures?

This week, Congressional representatives Stephen Lynch (D-MA) and Walter Jones (R-NC) have officially requested a congressional resolution demanding President Obama declassify the heavily redacted Congressional Investigative Report on 9/11.

The two representatives had just been given authority under penalty of “national security secrecy” to read the censored 28 pages of the 800-page report that had not been seen.

For nearly a decade, the US has maintained security policies, both domestic and international, based on threats now known to have been totally fabricated. The cost, trillions of dollars, thousands of Americans dead in wars against “enemies” long known to have never been involved in terror attacks on America, the phony “hunt for bin Laden,” all of it, nothing but utter hogwash.

Bush cited as conspirator

What has been made clear is that President Bush was fully aware that neither Afghanistan nor Iraq were involved in 9/11 and that military action against those two nations was done to cover involvement of his administration in 9/11, involvement that included support from foreign intelligence agencies.

The representatives, while reviewing the report, came to the portion titled “Specific Sources of Foreign Support.” A 28-page section here had been “butchered” by the White House on the personal orders of President Bush. On the original report given to Congress, an estimated 5-10,000 words were omitted from this section with page after page of dotted lines replacing text.

The full report carries a tale of not only broad complicity of foreign intelligence agencies but, in the use of the term “complicity,” indications of full knowledge of the funding and planning of 9/11 by the Bush administration.

However, the lawmakers, without the support of a resolution, are under a “gag order” and unable to name the nation or nations that supplied.

Israel, Saudi Arabia or both

Recent revelations tied to events in Syria and Egypt have exposed an unimagined level of cooperation between the intelligence services of Israel and Saudi Arabia. For years, Israel has cited Saudi Arabia as the greatest threat to their security, much greater than Iraq under Saddam or their claims of a “nuclear Iran.” This and much else of what Israel has publicly claimed as part of their “mythology of victimization” is now recognized as falsehood. Though both Israel and Saudi Arabia are known as allies of the US, their partnerships with America have been with specific groups, extremists within government and the military willing to back the plots now plainly evident even when US interests are sacrificed or even American lives are lost.

Telling, today, is the relationship between Al-Nusra and other al-Qaeda “franchises” and the Israeli/Saudi alliance, a relationship that has provided both financial support and weapons, used against Syria, Lebanon and Iraq.

The sections of the 9/11 report that were censored by President Bush may well include reference to that al-Qaeda/Israel/Saudi nexus. What is clear is that not only did the Bush administration wrongly blame bin Laden or “al-Qaeda,” a spurious and illusory group at best, but that those cited, Israel, Saudi Arabia or both, though named for funding and supporting the 9/11 attack, were always under the full control of the Bush administration.

What does exist is proof that the war on terror was, in reality as confirmed by General Wesley Clark, a plan to invade and occupy 7 oil- and gas-rich nations.

Israel put the blame on Saudi Arabia

In an article released yesterday on www.familysecuritymatters.org , Paul Sperry of the Hoover Institute cited, not just the Saudi government as having been behind 9/11 but set the relationship between George W. Bush and Prince Bandar at the crux of the conspiracy.

After the 9/11 attacks, the public was told al-Qaeda acted alone, with no state sponsors. “But the White House never let it see an entire section of Congress’ investigative report on 9/11 dealing with “specific sources of foreign support” for the 19 hijackers, 15 of whom were Saudi nationals.

It was kept secret and remains so today. President Bush inexplicably censored 28 full pages of the 800-page report.”

Sperry goes on: “Saudi consulate official Fahad al-Thumairy allegedly arranged for an advance team to receive two of the Saudi hijackers - Khalid al-Mihdhar and Nawaf al-Hazmi - as they arrived at LAX in 2000.”

Sperry goes on citing instance after instance where Saudi intelligence directly aided al-Qaeda every step of the way.

What is important is that we understand who Sperry represents. Family Security Matters isn’t a simple blog. It is the voice of not just the extreme right but AIPAC as well. Their editors include Senator Ted Cruz, top GOP domestic policy maker and former UN Ambassador John Bolton, Islamophobe extremist, “Israel Firster” and a man who never saw a war he didn’t love.

“Family Matters” is the power center for everything pro-money, pro-hate and pro-Israel. Self-proclaimed “investigative journalist Paul Sperry serves with the Hoover Institute, along with former Secretary of State Condi Rice. The critical aspect of yesterday’s article is that it represents the first time the Israel lobby has been willing to throw former President Bush “under a bus” in order to distance themselves from accusations of complicity in 9/11.

Prior to the exposure of Israel’s role as “mentor” for al-Qaeda in Syria, America’s media was able to suppress not just “conspiracy theories” but accusations backed by evidence and testimony that placed Israel at the center of the 9/11 attacks.

Prince Bandar accused of planning 9/11

Though there is no reason to assume Saudi Arabia is mentioned whatsoever in the redacted Congressional report, Sperry cites payments by Bandar to the alleged 9/11 hijackers and other funding to al-Qaeda.

“Other al Qaeda funding was traced back to Bandar and his embassy - so much so that by 2004 Riggs Bank of Washington had dropped the Saudis as a client. The next year, as a number of embassy employees popped up in terror probes, Riyadh recalled Bandar.”

Real from conjecture

Members of Congress have openly admitted that they have seen documentation that would support an immediate criminal investigation against President Bush (43) and his closest advisors. Further, those agencies involved in compiling this report, key portions of which have remained secret, were also responsible for lying to the 9/11 Commission, not just through omission. All the intelligence that sent America into two wars is now not just suspect, it is proven false.

Recognizing that the nations responsible have not yet been named, though attempts by Family Security Matters to subvert this process are underway, what does stand is evidence of the same conspiracy.

From a CIA transcript dated September 24, 2001, Osama bin Laden is quoted: “The United States should try to trace the perpetrators of these attacks within itself; the people who are a part of the US system, but are dissenting against it. Or those who are working for some other system; persons who want to make the present century as a century of conflict between Islam and Christianity so that their own civilization, nation, country, or ideology could survive.”

Family Security Matters celebrates the death of Osama bin Laden as a terrorist fanatic. They also celebrate the death of Nelson Mandela as a terrorist fanatic. Mandela was right, as history has shown.

In Japan, thousands of people have held a demonstration to denounce the government's decision to enact a state-secrets law to toughen penalties for whistleblowers and journalists.

Thousands of protesters, who braved Tokyo's cold weather, gathered across from the parliament building, chanting anti-government slogans. Under the state-secrets law, anyone who leaks information about the Fukushima nuclear disaster or the country's tense relations with China could face a long prison sentence. Journalists and others in the private sector convicted of encouraging such leaks would be put behind bars up to five years if they use inappropriate means to solicit the information. Prime Minister Shinzo Abe has said the law is needed to persuade allies like the U-S to share intelligence. The ratification of the law came as a worldwide debate on secrecy is underway, sparked by US whistleblower Edward Snowden's leaks of classified documents.

Japan has enacted a new law to increase punishment for leaks, despite growing worries that the state-secrets law will erode press freedoms.

Last week Japan’s lower house of parliament gave the greenlight to the new legislation, which counts the support of conservative prime minister Shinzo Abe, who has said the measure is necessary to combat the leak of state secrets.

Abe and members of his cabinet have said that the law will help mend the government’s reputation for leaks and facilitate the sharing of intelligence with the US.

"We think that this law is extremely important for our connections with our allies and other foreign nations," said chief cabinet secretary Yoshihide Suga. "I believe that people will come to understand."

According to a survey by Asahi Shimbun 61 percent of Japanese voters believe the law is “problematic,” and it has garnered the opposition of the media, publishers and the country’s lawyers. Opposition parties even mounted a challenge to the new bill, which was passed during a late-night session of the country’s upper chamber.

Members of the opposition raised motions to stop or delay the law but were overruled by members of the ruling Liberal Democratic Party and its allies.

The new law enacts harsher sentences for public servants and others with access to sensitive national information, and could lead to jail terms of up to ten years. Meanwhile, journalists in the country could face up to five years imprisonment if the state determines the use of “grossly inappropriate” means to acquire state secrets.

Officials in Japan’s ministries will now be given the authority to designate state secrets in four categories: defense, diplomacy, counterterrorism and counterespionage. Such a classification will allow information be kept secret for up to 60 years or longer.

Still, opposition to the new legislation has come from a wide variety of sectors. Takao Takeda, a Buddhist monk and the secretary of the multi-faith organization Shukyosha Kyujo-no-wa, said that the bill echoed Japan’s authoritarian past.

"The bill being discussed now seems very similar to the Public Order Preservation Law" enacted in 1925, Takeda told AFP. That law enabled Imperial Japan to arrest anyone who voiced a dissenting view against the government, said Takeda.

"It is important to protect people's rights to know given our history and the way information was hidden in (World War II) and the fact that the government was not very open in the face of the [Fukushima] nuclear crisis."

Likewise, Japan’s media has also protested the new law.

"It is a threat to democracy," said Keiichi Kiriyama, editorial writer of the Tokyo Shimbun. The state-secrets law would "have a chilling effect on public servants who could become wary about giving the information" sought by journalists, he added.

Prime Minister Abe has said that the law is necessary to bolster the country’s security, in tandem with the creation of a new National Securities Council and cooperation with the US amid concerns over China’s growing military projection.

Critics worry that the new legislation lacks checks and balances as to how the state will define a secret, while Abe has said that his government will set up panels to legitimize that process.

Japanese Govt rams state secrets bill through lower house to cover up Nuclear Disasters at Fukushima

Japan’s lower house has passed a heavy-handed state secrets act despite fears that it will have severe repercussions for state freedoms. Officials will now face a maximum punishment of ten years in prison if they are found to have leaked to the press.

Japan’s Diet (parliament) passed the bill, which is aimed at expanding the definition of a state secret and place increasing penalties upon anyone deemed a leaker. The move will apparently prevent media accessing information on four sensitive areas: defense, diplomacy, counter-terrorism and counter-espionage.

The information will be further divided into 23 types. Top officials from all departments would have the power to declare issues ‘secret’. The ‘secrets’ could then be kept classified for up to 60 years.

Journalists and other private sector parties could also receive up to five years imprisonment if they are found to be using ‘grossly inappropriate’ means to acquire information.

Such restrictions could spill over into the nuclear industry. The topic is particularly sensitive in the face of March 2011’s Fukushima nuclear disaster, which drove over 160,000 residents from their homes.

“Information on the vulnerability of nuclear power plants could be classified as special secrets, along with plans on how to guard the plants,”Yutaka Saito, a lawyer and a member of the Japan Federation of Bar Associations' task force on the bill, told Reuters

If so, anyone who has blown the whistle from the inside to warn of the danger of nuclear power plants will be punished,”Saito said.

The bill was adopted through majority vote by the ruling coalition after Prime Minister Shinzo Abe's Liberal Democratic Party (LDP), New Komeito, and the Opposition Your Party all agreed to revisions last week to gain the votes of small conservative opposition parties.

The move comes despite overwhelming public opposition, and after members of opposition parties - including the Democratic Party of Japan (DPJ), the Japan Restoration Party, the Japanese Communist Party and the People's Life Party – said that insufficient debate had been conducted prior to the vote. Critics allege that changes to the bill were merely cosmetic, and requested that it not be brought to vote. Regardless, the legislation was approved after only a few hours worth of delay

Nearly 63 percent of respondents to a Kyodo news agency survey expressed concerns about the bill last week, and its discussion triggered protests by hundreds of people outside of parliament on Tuesday. Thousands gathered in a Tokyo park the previous week to rally against the bill.

“We revised the proposal as much as possible to address the concerns held by the public,” Gen Nakatani, an LDP director, said following the vote, while Atsushi Oshima, a DPJ director declared that it had been a “defeat for the legislative branch.”

The bill has now been sent to the Diet’s Upper House for consideration, where it will likely pass without any difficulty. The LDP and its junior partner hold a solid majority in both houses.

“Clearly, there will be a chilling effect on access to a wide range of information,”
said Meiji University law professor, Lawrence Repeta, said. “It is clearly aimed at news media to block reporting in a way that may be critical of the government on a wide range of sensitive issues,” he added.

Abe has stated that the law is vital in the development of a US-style National Security Council to coordinate foreign policy and security while negotiating with allies such as the US over the possible sharing of information.

“My biggest concern is that it would be more difficult for the people to see the government's decision-making process,” said Kyouji Yanagisawa, a former defense official who was in charge of national security in the Prime Minister's Office in 2004-2009. “That means we can't check how or where the government made mistakes, or help the government make a wise decision
.”

Mainstream Journalists Expose 9/11 Cover Up

Several leading American mainstream journalists say that the US government is lying about 9/11 and the so-called war on terror. Unfortunately, media owners and editors won't let them report their findings.
 
Recently, Seymour Hersh, America's top mainstream investigative reporter, broke the news that the US government's claim to have killed Osama Bin Laden on May 2nd, 2011 is “a big lie. There is not one word of truth in it.”

Hersh went on to harshly criticize his long-time employer, the New York Times, and other big media outlets: “We lie about everything, lying has become the staple.” He said all big US media outlets should be shut down for lying to the American people.

Other mainstream journalists agree that the US government’s story of Osama Bin Laden and 9/11 is a big lie. Sherwood Ross, an award-winning journalist who has worked for the City News Bureau of Chicago, the Chicago Daily News, and for Reuters and other wire services, told me in a recent radio interview:

“It's very doubtful that Muslims were behind 9/11. Think about this for one minute: That President Bush's family had done business with the family of the man who allegedly made the terrorist attack, Osama Bin Laden. The Bin Laden family was actually on the board of Bush's oil company. How is it possible that of all the billions of families in the world, the one family that makes the attack on America has done business with the President of America. That sounds more like a favor than anything else. I don't think 9/11 was an Arab conspiracy or a Muslim conspiracy. I think it's an American conspiracy to overthrow the government of the United States and install what is becoming a police state, and also to advance the imperial ambitions of the United States, to swindle the Middle East out of their energy resources.”

Ross explained that American journalists are no longer free to expose even the most outrageous official falsehoods and fabrications:

“You don't see any serious questioning by the mainstream media. I thought one of the tip-offs that it was a put-up job was when a cameraman from a little weekly in Pennsylvania went to the site where this airliner had supposedly crashed (on 9/11). And he said, 'I didn't see any airliner. I saw a hole in the ground. I didn't see any bodies. I didn't see any luggage.' All right, maybe that guy just made this up. But I don't think so. I think he was just doing his job. And then at the Pentagon, you had the claim that airliner hit it. But again, there was no wreckage. Reporters who worked in the Press Room at the Pentagon went out there on the lawn, and they couldn't see any airliner. So, over and over again, you have manufactured lies that the press largely is not reporting.”

I asked Ross whether he is allowed to express such views in his articles for the Miami Herald, the Chicago Daily News, or the wire services. He answered:

“Absolutely not. When I used to write for Reuters, covering workplace issues, for ten years, my columns were picked up from the New York Times to the L.A. Times. But if you write about 'why did 7 World Trade Center collapse when it wasn't hit by an airplane,' nobody will pick it up. So, now my columns are used on the Internet by bloggers, and they're used by Middle East wire services. I get phone calls from Press TV, and you can read my interviews there. But you won't see me quoted by the Associated Press.”

Another leading American journalist, Paul Craig Roberts, has also been banned from US mainstream media for telling the truth about 9/11. Dr. Roberts served as Assistant Secretary of the Treasury, won the French Legion of Honor and other awards for his contributions to economics, and has been a regular columnist for the Wall Street Journal, Business Week, and other mainstream publications. But since he spoke out about the controlled demolitions of the three World Trade Center skyscrapers on 9/11, Paul Craig Roberts has been put on the mainstream media's no-publish list.

In a recent interview on my radio show, Dr. Roberts explained why the US mainstream media, as Seymour Hersh said, lies about everything:

“One of the worst things that ever happened (to America) was when President Clinton allowed five companies to concentrate the American media. That destroyed its independence. And ever since Clinton permitted that, which was totally against all American tradition, and totally against the antitrust law ... but in the United States, as we've seen, law doesn't mean anything anymore. The minute these five conglomerates concentrated the media, the independence of the media disappeared. It's no longer run by journalists, it's run by corporate advertising executives. The value of these media conglomerates resides in their federal broadcast licenses. And so they can't dare offend the government. Their licenses may not get renewed, and the entire multi-billion-dollar value of the companies would disappear. So, the so-called mainstream media is no longer the media. It doesn't tell you anything. It's a propaganda ministry - the Ministry of Propaganda. Gerald Celente calls them 'presstitutes.'”

Rather than writing for the mainstream media, Paul Craig Roberts is now exposing the fake killing of Osama Bin Laden and deconstructing the 9/11 false-flag operation for an independent outlet called the Institute for Political Economy. In a recent article published on the 12th anniversary of the 9/11 attacks, Dr. Roberts wrote:

“The neoconservatives who advocate America’s hegemony over the world called for 'a new Pearl Harbor' that would allow them to launch wars of conquest ... No evidence exists that supports the government’s 9/11 story ... On this 12th anniversary of a false-flag event, it is unnecessary for me to report the voluminous evidence that conclusively proves that the official story is a lie. You can read it for yourself. It is available online. You can read what the architects and engineers (for 9/11 truth) have to say. You can read the scientists’ reports. You can hear from the first responders who were in the WTC towers. You can read the pilots who say that the maneuvers associated with the airliner that allegedly hit the Pentagon are beyond their skills and most certainly were not performed by inexperienced pilots. More importantly, today’s gathering would not be necessary if Federal and State policy makers and business executives believed that Fukushima Daiichi really happened. If they had believed what they saw on television, they would understand that nuclear accidents happen. Nuclear accidents are inevitable. They would understand that “Sooner or later, in any foolproof system, the fools are going to exceed the proofs!”

Indian Point presents an interesting dichotomy. The Nuclear Regulatory Commission (NRC) claims that the chance of a meltdown is one in a million. With 400 operating nuclear reactors worldwide, the NRC data means one meltdown would occur every 2,500 years. The NRC bases this analysis on a technique called Probabilistic Risk Assessment (PRA- pray for short). On old plants like Pilgrim and Indian Point, the NRC uses data from newer plants to show how reliable these plants will be to continue if they operate for the next 20-years. That’s like my doctor telling me how long I will live based on the heath statistics for 25-year-olds. If we apply the NRC’s methodology, the probability of what happened at Fukushima Daiichi is one million x million x million (a 1 with eighteen zeros) to one.

But that is not what has happened in real life. Instead, history shows us that there have been five meltdowns during the last 35 years: TMI, Chernobyl, and Fukushima Daiichi 1, 2, and 3 (apologies for not including Windscale, Santa Susana, and about a dozen more reactors). The real numbers show that there is a seven-year frequency between meltdowns. Policy makers and business interests are ignoring history as they attempt to force the relicensure of Indian Point.

While demanding that taxpayers cover the risk of a nuclear accident by paying for the Price-Anderson nuclear insurance, it seems that the NRC and every major politician and nuclear fabricator actually believes that A Nuclear Accident Can’t Happen at Indian Point or Pilgrim. When someone’s brain reasons in a way to justify support for what it wants to be true, psychologists call it “Motivated Reasoning”.

Recently I was asked to testify to the Canadian Nuclear Safety Commission because the Pickering Nuclear reactors have applied to operate beyond their useful life. Pickering is located only 20 miles away from the heart of Toronto. At the hearing in Toronto, speaker after speaker implored the CNSC to keep this aged nuclear plant running because it is a major employer that pays its taxes. They said that Pickering Nuclear Power Plant has great employees who live in town, who are on the school board, on the soccer teams, or sing in local church choirs. The statements suggested that surely, such nice people would know if their plant was unsafe.

This situation reminds me of Garrison Keillor and his tales about Lake Woebegone, where he would say, “…all the women are strong, all the men are good looking, and all the children are above average.” Every town I visit that has a nuclear plant believes its nuclear plant is better than average. If history has taught us anything, it’s that nuclear accidents happen despite the best intentions of the men and women who work there.

I knew the operators at Three Mile Island, they were active in their community and they lived near the plant, yet an accident happened. Nuclear Power is a technology that can have 40 good years and one bad day.

After the Chernobyl accident, I got to know some of the operators there, and they were brilliant engineers who were very safety conscious. They and their families lived very near to the Chernobyl reactor, and still an accident happened. This is a technology that can have forty good years and one bad day.

After I wrote my book Fukushima Daiichi: The Truth And The Future, I got to know some of the Fukushima Daiichi operators. Like the operators at TMI and Chernobyl, they too were meticulous and knew their reactor like a book. They also lived right near the Daiichi plants with their families. And yet, another accident happened. Nuclear Power is a technology that can have forty good years of operation and one very bad day.

Policy makers and business interests clearly want to believe the “forty good years” part of that sentence, but choose to ignore the “one very bad day”!

Companies like Entergy claim that their nuclear plants are “safe”. What does this mean??? This means that the Nuclear Regulatory Commission (NRC) has reviewed 5% of that plant’s paperwork and checked off in boxes that the paperwork existed. However, those same companies did not tell you that the nuclear industry lobbying group has vetted every NRC Commissioner for the past twenty years before they allowed Congress to approve those Commissioners. And, did you know that those same lobbyists worked with the NRC to write those power plant regulations? So safe to Entergy and other nuclear power plant owners means that plants like Indian Point comply with the minimum acceptable criteria established by a compliant regulator.

Let’s talk specifically about the corporations that own nuclear power plants, especially merchant plants.

1. The NRC has allowed many nuclear power plants to become Limited Liability Corporations (LLCs): corporations that are separate from the companies that own them. Why is that an issue or concern to the rest of us?

1.1. Did you notice that Indian Point 2 is a separate LLC from Indian Point 3? Two entirely separate legal entities. Why is that? It allows the Entergy to keep one plant running if the other one has a serious radiation release. It allows one unit to be declared bankrupt, while the other units continue to generate cash that can’t be spent on the radiation cleanup.

1.2. Entergy wouldn’t do such a thing, would they? One only has to look at New Orleans after Hurricane Katrina to see that Entergy has already used this legal maneuver. While the people of New Orleans where bailing out their city, Entergy’s New Orleans LLC subsidiary declared bankruptcy, and applied for federal disaster relief. The US government moved cash that had been destined to help New Orleans poor community through a Community Development Block Grant and gave it to Entergy. Entergy gave its executives bonuses.

2. What is the condition of these aging nuclear plants that have been operating 30 to 40-years and have reached the end of their design life?

2.1. According to the Indian Point Independent Safety Evaluation Report July 31, 2008: The physical condition of the plant …is visibly deficient… the care and maintenance of some other plant systems and structures do not meet the standards of high-performing plants… it is the Panel’s view that the maintenance and preservation of non-critical plant systems, equipment and structures is important, because it communicates to employees and the public alike the owner’s and operators’ commitment and professionalism. (Indian Point Independent Safety Evaluation Report July 31, 2008, page 11)

2.2. The Vermont Yankee Oversight Panel, convened by the State of Vermont, uncovered similar issues: “The issue of inadequate application of resources takes on heightened importance given Entergy’s status as an aging plant. Over the remainder of Entergy’s operating life, the possibility of shutdown within a few years can never be ruled out and will become a near certainty at some point. If the events of the last few years are any guide, Entergy has a tendency to focus expenditure on safety systems and systems of obvious reliability importance while withholding resources from systems that it deems of secondary reliability importance.” [Emphasis Added] “Limited resource allocation for non-safety systems might, therefore, be systemic within Entergy.”

2.3. Most recently, Entergy announced across the board staff cutbacks of five percent, euphemistically called its Human Capital Management Initiative. So, in spite of two independent panels determining that Entergy is not spending enough money, Entergy has decided to cut its staff at all of its aging and most vulnerable nuclear power reactors.

What you may ask is the NRC doing about this? Nothing, absolutely nothing. Instead, Neil Sheehan, the NRC Region 1 PR spokesperson said, “… the NRC has the ability to determine whether there are any adverse impacts through our Reactor Oversight process.” “If we observe any negative trends via inspection findings and/or performance indicators, we could determine if there was any linkage to human resource changes.”

To me, Sheehan’s quote says that after an accident, the NRC might determine that Entergy had cut too much staff.

For that matter, staff reductions have become the nuclear industry’s approach to make more money when electricity prices are down as they are now. The Millstone nuclear power plant in Connecticut “reduced staff to approach industry average”. The NRC allowed them to reduce staff. But if Millstone was above the industry average, then other plants must have been below the industry average. Why hasn’t the NRC approached those plants to increase the number of employees in order to measure up to the industry average? The industry only puts downward pressure on its reactor staffs, and the NRC is unwilling to put on the breaks.

Every day we at Fairewinds Energy Education receive questions asking us how American nuclear power plants compare with those that melted down at Fukushima Daiichi. Is Indian Point or Pilgrim really any different from Fukushima Daiichi? No! Actually both plants have many worse features:

Population centers are much closer to Indian Point and Pilgrim. And, before the Daiichi accident people believed that the emergency planning in Japan was far better than in US. Even Japan’s strong emergency plan failed because every safety system at Fukushima Daiichi failed.

The spent fuel pools at both Indian Point and Pilgrim holds five times more nuclear fuel that Fukushima Daiichi and they hold more cesium than all the atom bombs dropped in above ground testing. And, that is just cesium… think about all the other radioactive isotopes.

Indian Point and Pilgrim are the same age, first generation designs. Daiichi 1 started commercial operation in 1971 and had just received its authorization to run an additional 10 years only one month before the tsunami hit. Daiichi 2 started operation in 1974.

Fukushima Daiichi experienced an earthquake and tsunami, but what really knocked them out were the Loss of Offsite Power and the Loss of the Ultimate Heat Sink. Both could happen at Indian Point and Pilgrim. LoUHS can be created from a terrorist attack on the intake structure.

What about earthquake frequency? Indian Point has the highest probability of its nuclear core being damaged during an earthquake (core damage frequency) of any reactor in the US, according to the NRC by applying USGS seismic hazard curves. Experience at the North Anna nuclear plant in Virginia indicates that the frequency of a severe earthquake is grossly underestimated. The worst earthquake in 10,000 years was expected to be a Richter 6 at North Anna. Yet a Richter 6 happened in 30 years, meaning that the worst is yet to come. Indian Point has an earthquake fault one mile from the reactors that could easily create a quake greater than the plant was designed to withstand.

Let me sum this up. It is easy for the nuclear industry to allow arrogance to set in when one looks at the sheer size of a nuclear plant. I started my career in 1972 with a Master degree in nuclear engineering from RPI. The nuclear engineering department visited Indian Point when it was being completed. Both then and now, it is an impressive building. No one asks why does that building have to be so impressive? What is inside these plants that requires such an impressive structure in the first place?

But now that we have seen first hand that nuclear power safety systems can fail with catastrophic results, we need to ask why we should build such an uncontrollable and unmanageable technology. The forces within these plants are enormous, and must always be contained 24/7/365. Fukushima Daiichi, Chernobyl, and Three Mile Island proved just how utterly impossible it is to always contain these forces. One operator error or one significant weather event, or one earthquake or one terrorist attack, and all of New York City will face a very bad day, and like Japan, a very sad future.
